Definition and Legal Framework of Strategic Reserves

A strategic reserve refers to the stockpiling of goods by the state to ensure security during crisis situations. It encompasses energy resources, food supplies, and other critical materials. Management of these reserves is overseen by government agencies.

Constitutional Competence Analysis

The Act of 17 December 2020 on Strategic Reserves stipulates that “the types and quantities of strategic reserves are determined by the Government Strategic Reserves Program.” The process falls within the remit of the Minister of the Interior and other relevant ministries. The President is not mentioned in the legislation, which excludes direct presidential authority in this area.

Economic Justification

Analogous to the U.S. proposal, a Polish Bitcoin reserve could serve as:

  • An investment instrument with appreciation potential
  • A tool for partial reduction of public debt
  • Infrastructure for international payments in an era of potential trade conflicts

Political Analysis

The establishment of a Bitcoin reserve falls within the jurisdiction of the government, not the president. Mentzen’s declaration is likely a form of political marketing aimed at the cryptocurrency community, whose size in Poland remains limited and unlikely to exert significant electoral influence
